The trial of 66-year-old Terry Lee Wertz of Parnell, who was charged with two felonies related to a May hit-and-run crash that resulted in one death, is proceeding with discovery. Wertz has been charged with homicide by vehicle – reckless driving and leaving the scene of an accident resulting in death in connection with a May 27th incident that occurred near Fairfax. 

According to court records, Wertz was passing a vehicle driven by Willam Tomson on a two-lane road in a reckless manner with oncoming traffic. Tomson’s vehicle left the roadway to avoid being struck and entered the ditch. Authorities responded to the scene to find Tomson’s vehicle on its top in the ditch. Wertz allegedly did not stop or provide aid, and authorities located him at his house in Parnell.

Wertz waived his preliminary hearing, which was originally scheduled for July 31. 

Both Wertz and the state made motions for discovery on July 28, but on August 11, Wertz petitioned the judge to compel the state to produce discovery materials and allow for a deposition of the state’s witnesses. Both requests were granted, along with an order for Wertz to comply with any reciprocal discovery that arose from the process.

Wertz bonded out in July for $35,000. A date has not yet been set for his next appearance.
