A Washington man who was arrested last September for domestic abuse assault third or subsequent offense, a class D felony, was recently convicted on a lesser charge.

KCII previously reported that 42-year-old Nicholas Edward Furman was arrested after the Washington Police Department was called to a residence in the 2100 block of Lexington Boulevard. The victim stated that Furman shoved her, leaving scratch marks on her arm and headbutted her. Furman has two previous domestic abuse cases in Washington County that resulted in amended charges. The first was in 2019 that resulted in a simple misdemeanor assault conviction and the second in 2020 resulted in a serious misdemeanor. A filing from the court states that since the criminal complaint referenced a 2011 domestic abuse assault conviction in South Carolina which does not state the level of offense, and the two Washington County cases did not involve domestic abuse convictions, the court only found probable cause to charge Furman with domestic abuse assault second offense, a serious misdemeanor.

Through a plea agreement Furman was convicted of domestic abuse assault first offense, a simple misdemeanor, and all but 10 days of a 30-day jail sentence were suspended for him to be placed on one year of probation. He must also pay Category B restitution. Furman’s previous offenses in Washington County include interference with official acts causing bodily injury, a serious misdemeanor, and leaving the scene of an accident causing serious injury, an aggravated misdemeanor.
