The Iowa Court of Appeals has reversed a decision that sentenced a man for both child endangerment and involuntary manslaughter in the death of his six month old daughter. Jarod York asked the appeals court to merge the two sentences imposed in Washington County, because the manslaughter could not have happened without the lesser crime of child endangerment. Citing a 2006 Supreme Court ruling, the Appeals Court said that they could not presume that the legislature intended cumulative punishments. York’s case will be sent back to district court for resentencing.
