The trial for Justin Hay has been delayed indefinitely, after the defense submitted an application to the judge asking that Hay be evaluated for mental competency. Hay is charged with vehicular homicide and hit and run resulting in the death of Lindy Greenfield, stemming from an April 2016 incident in Mt. Pleasant. The trial was originally scheduled for December 13th, but was pushed back to January 10th due to several motions made to the judge. Now the trial could be delayed several months depending on the decision of the judge.
The Henry County Attorney’s office clarifies this is not a plea of mental incompetence relating to the April incident, as the plea of not guilty has already been entered. The attorney for the defense is stating Hay is currently not mentally fit to defend himself, and requesting the trial be temporarily suspended until he’s capable of speaking in his defense. Hay will be evaluated by a psychiatrist, and if the request is granted by the judge, he will be sent to a mental health facility to receive treatment until he’s deemed fit to resume the trial. The Henry County Attorney’s office will receive a report of the psychiatric evaluation, and if they don’t agree with it they can have their own psychiatrist look at Hay.
