A Fairfield man was arrested Wednesday and charged with sexual abuse in the third degree, a class C felony.

It is alleged that 32-year-old David Michael Phipps perpetrated a sex act against a person who was mentally incapacitated and incapable of providing consent. The alleged incident occurred in the early morning hours of Sunday, May 21.

Phipps is being held in the Jefferson County Jail on a cash or surety bond in the amount of $10,000. Sexual abuse in the third degree is a forcible felony under the laws of the State of Iowa.
