The Riverside City Council discussed the city administrator’s contract at their latest meeting. The focus of the discussion was retirement payments. Rusty Rogerson’s contract states the city will pay the employer’s share and employee’s share of retirement contributions. This has not occurred, meaning the city could owe Rogerson for not paying the employee’s share since he started in August of 2012.

Councilwoman Christine Kirkwood motioned to table the item until the city’s attorney provides the council with his opinion. Councilman Bob Schneider stated it was his opinion that the council lacked the right and authority to not pay Rogerson due to the fact they agreed to the terms of his contract.

After the motion to table the item passed, Rogerson stated he would file a breach of contract with the mayor, and that the council would have 30 days to hear it or they would be required to pay him his severance.

Kirkwood asked if it would constitute his resignation. Rogerson responded by stating that the council failing to act on the matter constitutes his termination.
